In Florida, a man who sustained brain damage as a result of being hit by a drunk driver has been awarded a $5 million dollar settlement in a personal injury lawsuit. In 2007, Dwight Grant was a passenger in a stopped vehicle. The vehicle was hit by an intoxicated Mathew Lyons while he was being chased by the police. Grant sustained fractures to his skull and face which resulted in brain damage to his frontal lobe. Due to the brain damage, he now suffers a seizure disorder which requires constant care. The counsel for the defense argued that Grant had not been diligent in taking his seizure medication which exacerbated his condition. The jury found that Grant was two percent liable for his condition. The parties ultimately agreed to the five million dollar award.

December 24th, 2011An out of court settlement of $100,000 was reached for a bicyclist who was injured when he hit a patch of ice and crashed on a pedestrian/bike path in Florence last winter. The president of the Florence Park District says he’s “disappointed in a system that allows a man riding a motorized bicycle on a winter night on a trail that doesn’t allow motorized vehicles to receive an insurance settlement.” Half of the settlement came from a Florence bar because snow was pushed onto the trail when the bar parking lot was plowed.
Class Action Suit Filed Against Mercedes
December 20th, 2011Mercedes Benz has been hit with a class action lawsuit in California. This lawsuit alleges that the premature wear in the M156 V8 engines leads to engine problems and in some cases failure of the engine. The suit also alleges that both Mercedes and AMG have known about this issue since 2007. The suit states that the camshafts used are made of cast nodular iron but the valve lifters used are made of 9310 grade steel. The combination of these metals contributes to premature wear of the M156 motors.
