The Six Most Common Causes of Car Wrecks

1.) Nearly 80 percent of auto accidents are due to distracted drivers. Examples of distraction include: cell phone usage, applying makeup, changing music, eating, etc.

2.) Most car accidents can be linked to traffic law violations. Common violations are: speeding, tailgating, improper lane changing, and the failure to yield the right of way.

3.) Driver error equally accounts for 80 percent of car accidents and is closely linked to driving while distracted. Some factors that contribute to driver error are: fatigue, drowsiness, distractions, and intoxication.

4.) Mechanical failures of a car such as brakes, tires, steering mechanisms, and suspension often lead to car wrecks and injuries. These are sometimes due to manufacturer design and often result in class action lawsuits which involve large settlements.

5.) Road conditions such as debris on the road or weather conditions like ice or rain can be an affording factor to car wrecks. Sometimes the government is the negligent party (for example a dangerous pothole that has been neglected for an extended period of time) and you may have a claim with that government entity.

6.) There are many flawed road designs that include intersections, merging lanes, traffic control devices, and other factors. The government may be held liable for such factors.

A quarter of 18-wheelers on the road in Texas are unsafe

One in four of the 18-wheelers on Texas’ highways have safety violations serious enough to be pulled off the highway.

That’s what the Department of Public Safety and other Texas law enforcement agencies found during a recent 72-hour period. Troopers inspected 7,993 commercial vehicles at random and discovered that 26.5 percent safety violations.

Throughout During the operation, DPS troopers inspected safety equipment and checked driver log books, driver licenses and endorsements. They also looked for possible drug or alcohol use.

Of the big rigs that were inspected, 26.5 percent were placed out of service because they were found to have serious enough safety violations to be removed from service until repairs could be made, including issues with the braking systems, tires, lights and safe loading.

Texas law enforcement officials have conducted this operation since 1988 and there has been a significant decrease in the commercial vehicle crash rate in North America since the program’s start. However, this year’s results echo previous year’s in that about a quarter of all trucks that were inspected have serious safety violations.

Truck driver blames rollover wreck on failed brakes

A Texas truck driver is suing the owner of a tractor-trailer after the truck’s brakes failed and he was injured in a rollover wreck.

Jose Gomez filed suit against Weatherford International Inc. over the big-rig truck wreck, which occurred May 20, 2010. Gomez said that the brakes in the 18-wheeler failed and he went through an intersection and rolled onto an embankment.

Gomez argues that Weatherford should have known that the braking system on the truck and trailer were not in proper working condition and that the brakes were inoperable thereby creating an unreasonable risk of danger.

The plaintiff is seeking damages for physical pain and mental anguish, medical expenses, physical impairment, lost earnings, loss of earning capacity, punitive damages, interest and court costs.
