Sudden acceleration plagues Jeeps, too

Imagine taking your vehicle to the car wash as you wait to emerge from the dark, wet, but clean tunnel your Jeep Grand Cherokee suddenly accelerates out of control.

How did this happen? Where do you start to get justification for this life threatening and in many cases deadly accident?

This is what happened to many victims not only at car washes but at service stations as well.

In 2002, 665 Jeep complaints were reported to the NHTSA. They denied a request to reconsider causes of the acceleration problem blaming them on the operator of the Jeep.

In 2006, the Connecticut state attorney asked the NHTRA to reconsider Jeep acceleration cases after another deadly incident; the request was denied again.

Why does the NHTSA keep denying these cases? How hard is it to look at the facts given and reconsider the problem?

Ford lied about cause of car wrecks

A  federal judge in Florida reversed a ruling on a fatal Ford car wreck case after discovering that the automaker’s testimony amounted to a calculated scheme to undermine judicial system’s ability to make a fair ruling.

Ford didn’t use just one piece of untruthful evidence. According to the judge, Ford covered up and destroyed years of testing and lies to save the reputation and sales within the company.

Although the amount of fraudulent information Ford presented in the 2003 case seems unending, main source of information came from the company’s knowledge of the acceleration problem and the failure to provide, produce, and record testing of the problem.

A Ford engineer had been warning the company about the risks posed by electromagnetic interference since 1973. Ford even maintained a $75 million reserve with could be utilized to cover a recall due to sudden accelerations.

Frivolous lawsuits or greedy victims are not the culprits in our legal system. It is when major companies abuse the system by concealing critical information, ignoring warnings from their own employees then lying about it all that leads independent juries to award damages.

Hot pavement could reveal defect in tires

You’ve heard the old joke about it being hot enough during the summer to fry an egg on the sidewalk.

In Texas, this is very nearly true. Sidewalks and pavement can get incredibly hot. Not only can these surfaces do a number on eggs and bare feet, they can do a number on your tires. This is especially true if your tires already have a manufacturing flaw.

So, if you are driving down the highway on one of our hot Texas afternoons and suffer a blow-out, it might have as much to do with the fact that you may have defective tires as with the heat.

But, in order to make sure, you have to preserve the evidence. So, if you’ve had a wreck, and you think a tire defect had anything to do with it, you need to preserve the evidence.

What would be evidence? Well, the tire itself along with any parts of the defective tire that may have shed would be really important as Exhibit A in a trial. Showing how the tread separated on the tire is important to show liability.

The vehicle itself should also be preserved.  Never let the insurance company take the vehicle away as that may be the last you see of this important evidence. Even the wheel rims are important to prove that the tire, and not the wheel, was defective.

Also, save all the other tires including the spare so there is evidence that the owner took care of their equipment.  This is also important because most sets are sold off the same production line at about the same time.

Don’t forget that all records, including purchase and maintenance records, are important evidence.
